4. STRATA TITLE

  • Allows foreigners to own apartments or units in co-owned buildings.
  • Subject to specific conditions (floor level, construction after 2010, etc.).
  • Provides full ownership rights over the purchased unit.

A BRIEF HISTORY OF THE LAND REGISTRATION SYSTEM

The Khmer Rouge regime (1975 to 1979) abolished private land ownership and the existing land registration system. Following their downfall, the Cambodian government initiated efforts to reconstruct the land registration system. The current land registration system in Cambodia is still in the process of development in rural regions, the government has implemented a cadastral survey system and is actively working on digitizing land records.

  • The 1992 Land Law laid the foundation for private ownership and the land registration system, based on the French Torrens system, but it has been adapted to the specific needs of Cambodia.
  • The 2001 revision enabled the issuance of land titles to Cambodian citizens.
